Offences and punishments under the ICT Act Bangladesh

This article gives an outline of the key offenses and penalties under the Information and Communication Technology (ICT) Act of 2006.

The ICT Act criminalizes the misuse of information and communication technology. Unauthorized access, data theft, cyber fraud, harassment, online defamation, and dissemination of obscene content are all common offenses. Electronic dissemination of false, vulgar, or defamatory information

If any person intentionally publishes or transmits or causes to be published or transmitted in the website or in electronic form any material that is false and obscene, or its effect is such that it tends to deprave and corrupt persons who are likely, given all relevant circumstances, to read, see, or hear the matter contained or embodied in it, or causes to deteriorate or creates the possibility of deteriorating law and order, or prejudices the image of the State or person

Punishment

Whoever commits the offense of posting false, obscene, or defamatory information in electronic form faces imprisonment for a minimum of 7 years and a maximum of 14 years, as well as a fine of up to 10 lac Taka, or both.

Hacking into a computer system

If any person does any act with the intent to cause or knowing that he is likely to cause wrongful loss or damage to the public or any person does any act and thereby destroys, deletes, or alters any information residing in a computer resource or diminishes its value or utility or affects it injuriously by any means or damages through illegal access to any such computer, computer network, or any other electronic system which does not belong to him, then such activity shall be treated as criminal.

Punishment

Whoever hacks a computer system faces imprisonment for a minimum of 7 years and a maximum of 14 years, or a fine of 10 lac Taka, or both.

Unauthorized access to protected systems

Any individual who secures or attempts to secure access to a protected system commits an offense.

Punishment

Whoever gains illegal access to protected systems faces imprisonment for a minimum of 7 years and a maximum of 14 years, as well as a fine of 10 lac Taka, or both.

Privacy and confidentiality disclosure

No one who has secured access to any electronic record, book, register, correspondence, information, document, or other material shall, without the consent of the person concerned, disclose such electronic record, book, register, correspondence, information, document, or other material to any other person.

Punishment

Any individual who violates confidentiality and privacy is subject to imprisonment for a term of up to two years or a fine of up to two lac Taka, or both.

Using a computer to help in the commission of an offense

Anyone who intentionally assists in committing offences under the ICT Act by utilizing any computer, e-mail, or computer network, resource, or system is guilty of an offense.

Punishment

Anyone who assists in the commission of an offence as defined above will face the same punishment as the core offender.
